Most Common Premises Liability Cases

Lawyers who practice Personal Injury Law typically have their workloads flooded with car accident cases but every now and then a premises liability case comes along. Premises liability defines a case where a party was injured on someone else’s property due to some type of unsafe or defective condition. In Florida, the following are the most common premises liability cases:

Slip and Fall 

Slip and Fall cases are perhaps the most common premises liability cases that we see at the firm. These sorts of accidents occur primarily in public businesses. For instance, if you’re in a supermarket and an employee has just mopped the floors but failed to put up a slipping hazard sign, you have the potential to miss seeing the wet area, slip and fall, and sustain significant injuries depending on the impact of the fall. Another common example of customers falling and hurting themselves on a business’ property is in parking lots. A root breaks through concrete and creates a tripping hazard for patrons or there’s a dangerous construction zone that wasn’t cordoned off properly. There are many ways accidents can occur on a business’ property that are easily preventable but often occur simply due to absentmindedness of employees or business owners.

Negligent Security

A common example of premises liability is negligent security. Businesses and individuals are always partially responsible for injuries or crimes that occur on their property. For public businesses, a weak security system or lack of surveillance personnel can lead to serious crimes such as sexual assualt or theft. However, a common negligent security matter that occurs on private property is dog bite cases. For example, if a mail courier delivers packages to a residence and there is an aggressive dog that is loose on the property and is not being supervised, this dog has the potential to attack the courier and inflict significant harm. The owner of the animal and of the property is then responsible for the injuries the courier sustained by the dog.

Inadequate Property Maintenance

Ever lived in an apartment complex that had a mold problem? Or have you ever stayed at a hotel and been electrocuted when plugging in a hair dryer or charger?
