Medical malpractice
occurs when a physician or healthcare provider commits an error
that results in injury or death. While an unexpected or negative
outcome following a procedure is not enough to constitute negligence,
the failure to diagnose an easily detectable illness, or a death
or injury caused by the failure to provide reasonably appropriate
or "common standards" of care, may be considered malpractice.
Examples of medical malpractice include failing
to properly read an x-ray where a cancerous tumor is present;
administering excessive doses of medication; misdiagnosing a
life-threatening condition; performing surgery on the wrong limb;
failure to remove a surgical sponge or other equipment after
an operation.
